You shall be deemed to have fully understood and accepted all of the matters addressed below, which contain important information about visiting and/or using the Apsiyon, as an inseparable whole, starting from your first visit to Apsiyon.
1. Parties and Subject
1.1. The Terms of Use herein shall be valid for all persons who visit Apsiyon. Therefore, please read the terms outlined below carefully. If you do not accept these conditions, do not visit and/or use Apsiyon.
1.2. Apsiyon is owned by Apsiyon Bilişim Sistemleri Sanayi ve Ticaret A.Ş. (“Apsiyon”) based in “TRC Plaza Altayçeşme Mah. Öz Sk. No:19 34843 Maltepe / Istanbul. Services offered through the Apsiyon app shall be provided by Apsiyon. Apsiyon reserves the right to change the existing or future information, forms, content of any kind on the Platform, as well as these Terms of Use, at any time, without further notice.
1.3. Apsiyon shall have the right to change the conditions specified in these Terms of Use at any time and without any notice. These changes shall apply to all who visit or use the Platform as of the day these Terms of Use are published on the website. The Terms of Use herein cannot be changed unilaterally by the User.
1.4. The subject of this Agreement is to determine the terms and conditions regarding the use of the Platform and the Services by the User and regulate the rights and obligations of the Parties. Any and all rules, announcements, and statements to be made on the Platform regarding its use and other issues shall be considered to be integral parts of the Terms of Use. With these Terms of Use, the User accepts all kinds of rules, announcements, notices, and declarations specified on the Platform in advance.
2. Definitions
3.1. Apsiyon is an auxiliary platform that offers digital services for community association managers and management companies authorized by community associations. Apsiyon provides comprehensive services to the community association managers and residents within the scope of the concluded service agreement with the community association managers and management companies authorized by the community associations. As such, Apsiyon possesses the title of "hosting provider" as defined in the Law No. 5651 on the Regulation of Broadcasts via Internet and Prevention of Crimes Committed through Such Broadcasts in terms of the Services it provides through the Platform, and the User accepts and declares that Apsiyon holds no responsibility for the content posted on the Platform by the User and/or third parties other than the Apsiyon.
3.2. Making changes in the Services offered by Apsiyon, introducing new services, and changing the scope and delivery conditions of Services shall be at the sole discretion of Apsiyon. Apsiyon is entitled to use this authority unilaterally and without any notification at any time.
3.3. Apsiyon shall always have the right to make improvements or other updates on the Platform without giving any prior notice to the Users. The User accepts that the Platform may be temporarily inaccessible because of improvements and other changes being made to the platform.
3.4. Any legal, administrative, and criminal responsibility ensuing from the use of the Platform shall belong to the relevant Users. Apsiyon cannot be held directly and/or indirectly responsible for any damages incurred by third parties as a result of the User's activities on the Platform and/or actions incompatible with the Terms of Use and relevant legislation. With regard to all kinds of requests from third parties in this context, the damages to be incurred by Apsiyon due to the Users' failure to fulfill their obligations laid out in the Terms of Use or the relevant legislation shall be recourse to the User, to be paid together with the accessories at the first request.
3.5. The ability to access the Services provided through the Platform is largely dependent on the quality of the service provided by the respective Internet service provider. Apsiyon bears no commitment and/or responsibility regarding the service offered by Internet service providers or the quality of this service. Accordingly, the User accepts in advance that the Platform is not free of defects and that despite Apsiyon's well-intentioned efforts to the contrary, occasional technical failures and/or access barriers may occur.
3.6. The User accepts and declares that there may be outbound links on the Platform to websites and/or platforms, files, or content outside the control of Apsiyon, that third-party services may be offered but it does not necessarily mean that Apsiyon supports such services or their providers in any way or make any kind of declaration or give any guarantee about the websites of the said services or the information they contain and that Apsiyon shall bear no responsibility for the platforms, websites, files and content, services, or products accessed through such links. Accordingly, Apsiyon does not necessarily approve of any content accessed via external links on the Platform. If the User decides to access the content in question and in case that the personal data of the respective User needs to be shared with third parties for the User to be able to access the said content, the personal data shall be shared with the relevant third party after the User is informed and their explicit consent is obtained.
3.7. The User declares that he/she has completed the age of 18 and has the legal capacity to be a party to the Terms of Use herein.
3.8. The User accepts and undertakes in advance that he/she shall use the Platform and its Services in line with the terms of use set forth herein. Accordingly, the user shall comply with the Terms of Use and the rules and conditions published on the Platform, as well as the law, morality and decency, and honesty principles, in all of their activities on the Platform, that they shall not engage in activities that may undermine the operation of the Platform by any means, as well as those that may infringe or threaten to violate the rights of third parties.
3.9. The User accepts, declares, and undertakes that the information they provide in order to benefit from the Services is correct and up-to-date that and belongs to them. Personal data shared with Apsiyon shall be processed in line with the provisions of the Personal Data Protection Law No. 6698 (“PDPL”). 4. Intellectual Property
4.1. All rights regarding the software, images and designs, texts, logos, and graphics used on the Platform belong to Apsiyon. Under no circumstances shall the information and/or software be copied or used for purposes other than those related to the Platform and the pictures, texts, images, files, etc. be copied, distributed, processed, or used in any other way. Accordingly, the User accepts and undertakes not to copy, modify, create derivatives of or expose the Platform and/or its content and put them into commercial use, and that otherwise, they shall be legally and criminally liable, in which case they shall be obligated to compensate all the losses incurred by Apsiyon.
4.2. Under no circumstances shall the Users (i) Take any action that may threaten the security of the Platform, prevent the operation of the Platform software, or hinder other Users from using the Platform and/or harm them, (ii) Impose a disproportionately large load on the infrastructure of the Platform; access, copy delete, modify, or attempt to access information published on the Platform and/or posted by others without authorization, (iii) Use or try to use software that will prevent the operation of the Platform and its software, disrupt the operation of all kinds of software, hardware, and servers, cause them to break down, reverse engineer, organize cyber-attacks, or intervene in other ways, and attempt to gain unauthorized access to Apsiyon servers.
5. Limitation of Liability
5.1. Apsiyon shall not be held liable for any direct or indirect damages that may ensue from entering the Platform, using the Platform or the information, data, or software on the Platform, using services, gross negligence due to the violation of the Terms of Use, acts of injustice, or other reasons. Apsiyon shall accept no liability for situations such as errors, negligence, deletion or loss of data, delay of transactions or communication, computer virus infection, errors in communication, hacking, computer crashes, unauthorized entries, and modification or use of records that arise out of the violation of the Terms of Use, acts of injustice, negligence, or other reasons. The User holds Apsiyon harmless of all kinds of damages and claims, including any liability, court costs, and other costs, that may ensue from accessing websites the links of which are provided on the Platform or using the Platform.
5.2. The User accepts and declares that Apsiyon holds no responsibility to investigate the authenticity, originality, security, or accuracy of any information shared on the Platform, and to determine whether sharing a piece of information is in accordance with the law or not and that Apsiyon will not be liable for the damages that may ensue because of the said information.
5.3. The User shall be exclusively responsible for all risks related to the use of the Platform and the Services. The User accepts the Services "as laid out" in the Terms of Use as of the effective date. Within the scope of the Terms of Use herein, Apsiyon gives no explicit or implied guarantee regarding commercial suitability, fitness for a particular purpose or use, or non-infringement. Apsiyon does not guarantee that all requests of the User will be met; however, it does reserve the right to make changes in the service content, features, and/or modules to improve service quality or expand the scope of or diversify the services provided. Such changes shall be published online and valid as of the date of publication. The User does not have the right to make any demands from Apsiyon on the basis of such changes. The User accepts, declares, and undertakes that they shall not make any demands from Apsiyon whatsoever regarding the use of the Platform, that Apsiyon has given no guarantee or promise that the Platform and/or the Services will be flawless and/or will meet all the expectations of the User. Apsiyon shall not be held responsible for any direct, indirect, special, incidental, or penal damages, including but not limited to the loss of profits and the loss of goodwill and reputation, caused by the actions of the Users using the Services.
6. Dispute Resolution
6.1. In the resolution of any and all disputes that may arise from these Terms of Use, the provisions herein shall have precedence, and relevant legislation of the Republic of Turkey shall govern all disputes that are not covered by this document. Istanbul Anatolian Courts and Execution Offices shall be authorized in the resolution of disputes arising from the implementation of the Terms of Use herein.

Apsiyon collects and uses Personal Data that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personal Data in accordance with our website.
As part of the registration process, you agree to the following terms and conditions with regards to Apsiyon’s use of personal data. Please read this Privacy Policy carefully and ensure that you understand it. If you do not accept and agree with this Privacy Policy, you must stop using the Website and Apsiyon’s Services immediately.
1.1. Apsiyon Bilisim Sistemleri A.S., a company established under the laws of the Republic of Turkey, with its registered office at Altayçeşme Mah. Öz Sokak No:19 TRC Plaza Ofis 6 34843 Maltepe / İstanbul – Turkey (“Apsiyon” or “We”) is an auxiliary platform that offers digital services for community association managers and management companies authorized by the community associations. Apsiyon provides comprehensive services to residents within the scope of the concluded service agreement with the community association managers and management companies authorized by the community associations.
1.2. This Privacy Policy applies only to the use of the Website. The Website may contain links to other websites. Apsiyon has no control over how personal data is collected, stored, or used by other websites and advise you to check the privacy policies of any such websites before providing any data to them.
2.1. All personal data are processed within the scope of the Services, in accordance with the law, accurately and in an up-to-date manner, for legitimate purposes, and as a part of our business activities for limited purposes.
2.2. Personal data is processed and stored for users to benefit from the Services. Depending on the Services provided by Apsiyon, personal data may be collected by automatic or non-automatic methods, and in cases where Apsiyon, primarily the Website, mediates the services provided, personal data may also be collected verbally, in writing, or electronically. For as long as Customers benefit from the Services and/or the contractual relationship continues between Apsiyon and Customers, personal data may be processed as per the consent given or within the framework of the regulations regarding personal data of which Apsiyon is subject to.
3.1. The data provided to Apsiyon by the Customers include personal data such as e-mail address, name, surname, identification number, identity details, home or work address, and phone number; demographic data such as postal code, age, gender, preferences, interests, and favorites; and in cases where payments are collected via the Website, payment information, and other similar data are stored by Apsiyon.
3.2. Apsiyon may process user activities on the system during the use of the Services for improvement and statistical purposes. In such cases, data such as the website that directed users to the Website, the search engines and keywords users used to find the Website, the pages users view on the Website, and users' browser extensions and browser size may be processed. We use analysis tools to collect this data. We use technologies such as cookies and web beacons to collect data regarding the pages users view, the links users click, and their other activities on our website or app. Additionally, we may receive some standard data that users' browser sends to all websites visited, such as IP address, browser type and language, time of access, and linking Websites.
3.3. We may use web beacons, customized links, or similar technologies to determine whether the newsletter or promotional e-mail sent by Apsiyon has been opened and which links users have clicked.
3.4. Apsiyon collects and uses the personal data necessary to maintain operation and improve services. These may include conducting research and analysis in order to provide better service to Customers, facilitate the use of Services by eliminating the need to re-enter the same information, and improve the Services, as well as displaying customized content based on user interests and preferences.
3.5. We also use personal data to contact you. We may contact users as a part of the Services such as welcoming via emails, dues and payment reminders, announcements by the community manager, surveys and forum notifications, information about technical service issues, and announcements.
3.6. When you fill out the forms on the Website, your personal data shall be processed for limited purposes in line with the reason for submitting the form and for providing information about the Services via e-mail or SMS provided that consent is given by users for receiving electronic messages of commercial nature.
3.7. The collected personal data are processed in compliance with the legislation with the aims of taking the necessary actions to ensure easy and reliable performance by the Services, customizing the Services to meet user demands, needs, and habits, determining and evaluating the commercial strategies of Apsiyon, and ensuring that the legal processes between the users and Apsiyon can be carried out quickly and properly. Accordingly, personal data are processed for the following purposes:
3.8. Sensitive personal data (religion, sect, ethnicity, race, etc.) will not be requested and processed by Apsiyon without express consent. We process personal data only for the purposes listed in this Privacy Policy and we do not process sensitive personal data that may lead to discrimination, in any way.
3.9. To help prevent unauthorized access to personal data, users must log in with their own credentials (email address, mobile phone, and password) and not share their credentials with third parties. The Apsiyon profile, where login information can be updated and personal data can be accessed, and/or viewed can be accessed through the profile page.
3.10. We do not store credit card information.
3.11. We process personal data only in line with the purpose of collecting them. In other words, if consent has not been given by users while giving personal data to the community management office or via our website, users will not receive advertisements, promotional or other kinds of emails, or SMS. If you think that you have been contacted in one of these ways although you have not consented, please check your consent settings on your subscription page.

4.1. Apsiyon holds the ISO/IEC 27001 Certificate for Information Security Management Systems. Accordingly, Apsiyon stores all data in accordance with the security measures required by the ISO/IEC 27001 Certificate. Holder of the ISO/IEC 27001 certificate, which requires the active adoption of data security policies, Apsiyon is regularly audited.
4.2. Protecting personal data is a priority for Apsiyon. We utilize a wide range of technologies and procedures to help protect personal data from unauthorized access, use, and disclosure. We store personal data in systems of computers located in controlled facilities to which access is limited. While transferring highly confidential data such as credit card numbers or passwords over the Internet, we use encryption methods such as the Secure Login Layer (SSL) protocol to protect these data.
4.3. If accounts and personal data are password-protected, it is the users' responsibility to keep their passwords confidential. The password must not be shared with others. In cases where users share a computer with others, it is of great importance to log out before leaving a website or a service in order to ensure that the next users cannot access login information.
4.4. Apsiyon is the data processor with regards to their contractual relationship with the Customers. Therefore, the necessary measures that are specified in the regulations shall be taken by the Customers. However Apsiyon, as data controller, as per the applicable regulation and in compliance with contracts concluded with the community association managers and the authorized management companies of the community associations, has undertaken the responsibility to create the necessary organization to ensure data confidentiality and integrity, as well as to take and adapt the necessary technical measures. The processing and storage of users' personal data are carried out only by authorized and trained personnel and in areas where data security can be ensured.
4.5. Personal data will be collected only within Apsiyon's scope of activity and for specific purposes, stored for as long as required by the reasons for processing this data and/or for the period stipulated in the applicable legislation and they will not be processed in a manner that is contrary to the provisions of the applicable legislation, and in cases where there is no reason requiring the processing of these data, apart from the cases where there is an obligation to store such data as per other applicable legislation, they will be deleted, destroyed or anonymized upon the request of the user or ex officio.
4.6. Additionally, we regularly train our employees and take the necessary measures to prevent employees from accessing personal data that are not related to their duties and sharing the data to which they have access with other parties outside the Company.
5.1. Apsiyon operates in compliance with the applicable regulation regarding transfer of data. In principle, personal data is not transferred to third parties without the consent of the data subject, in compliance with the provisions of the applicable legislation. However, in line with the purposes of processing personal data and with the condition that necessary security measures are taken, the collected personal data may be disclosed to third parties, our business partners, our associates, payment service organizations, and, in line with our purpose of service and activity or in cases stipulated by the relevant legislation, to regulatory and supervisory institutions and official authorities.
5.2. Personal data will not be shared with third parties except for the cases stated in the Clause 5.1.. Personal data will not be shared with third parties for commercial purposes. In some cases, we may establish contractual relationships with third parties to perform certain limited services on behalf of Apsiyon, such as processing and delivering mail, providing customer support services, hosting websites, conducting business transactions, or performing statistical analysis regarding our services. These service providers may need only the data required to provide their services. In such cases, the use of such data for purposes other than its intended use is prohibited and the said service providers must maintain the confidentiality of the respective data.
6.1. Apsiyon is a platform designed to provide assistance to the community association managers and management companies authorized by community associations for the provision of quality service to residents; so Apsiyon bears no responsibility for data entered into its systems by the Customers without being subject to Apsiyon's approval and/or evaluation processes.
6.2. Accordingly, Apsiyon will not interfere with the personal data entered into the Website by the Customers as a part of the Services. Therefore, in some cases, it may not be possible to meet data subjects’ requests that are also stated below. In such cases, We accept, declare, and undertake that We will inform, upon your request, the relevant community association management and the management company authorized by the community association.
7.1. Data subjects have the right to be informed about Apsiyon’s collection and use of personal data; the right of access to the personal data Apsiyon holds about the data subject; the right to rectification if any personal data Apsiyon holds about the data subject is inaccurate or incomplete; the right to be forgotten – i.e. the right to ask Apsiyon to delete any personal data; the right to restrict the processing of your personal data; the right to data portability (obtaining a copy of your personal data to re-use with another service or organization); the right to object using their personal data for particular purposes; and rights with respect to automated decision making and profiling.
7.2. In order to exercise these rights, data subjects may submit a written application to the address below by adding their name, surname, signature, identification number if they you are a Turkish national, passport number, or if any, your identification number if you are not, residence or workplace address of correspondence, contact email address or telephone number, the reason for the application and attaching other necessary information and documents for identification.
